Applicant Privacy Policy and Consent to Use Job Application Data

Your privacy is important to Toth and Associates, Inc. ("TOTH"). TOTH respects the privacy of applicants and employees and is committed to complying with applicable privacy and personal data protection laws. This Applicant Privacy Policy is intended to inform you about how the personal information you submit as a job applicant will be handled and protected by TOTH. All job application data you submit to TOTH is collected by TOTH based in Springfield, Missouri, USA.

Why We Collect and Use Personal Information

TOTH collects and uses your personal information for the purpose of determining your qualifications for employment and reaching a hiring decision, as well as to comply with applicable laws and regulations, such as laws related to the evaluation of those seeking employment, or to support TOTH's legitimate basis under such laws for collecting the information. If you are hired, relevant portions of your personal information will be used to establish an employment record. We do not collect or use the personal information you submit as a job applicant for unrelated purposes.

How We Collect Personal Information

Most of the personal information TOTH receives is collected directly from your application and résumé. We may also collect information about you from third parties in order to: (a) verify information about your credentials, such as education and prior employment, (b) follow-up on references that you may provide, and (c) conduct background investigations. It is TOTH's policy to collect such information from third parties only with your knowledge and agreement. Should TOTH wish to obtain such third-party information about you, and you have not completed an employment application authorizing us to do so, we will contact you and request your authorization to proceed.

What Types of Personal Information Do We Collect and How Is it Used

This Applicant Privacy Policy covers any job application data you submit, such as:

  • Name, address, email address, telephone number, or other contact information;
  • Information contained in your résumé or cover letter, such as previous work experience, education, or additional information you provide for our consideration;
  • Type of employment sought, desired salary, willingness to relocate, or other job preferences; and
  • Names and contact information for references (It is your responsibility to obtain consent from references before providing their personal information to us.)

To avoid doubt, TOTH does not wish to receive any confidential or proprietary (or patented) information you have received from your previous employers.

The information you provide will be used to assess your employment application, verify your information, conduct reference checks, and communicate with you and inform you of further career opportunities. If you accept employment with TOTH, the relevant information collected will become part of your employment record and will be used for employment purposes.

Who May Access Your Personal Information and Safeguards

Only select employees of TOTH, such as your potential future supervisor(s), human resources employees, or IT employees (for maintenance purposes), have access to certain portions of your job application data. In sum, access to your personal information will be restricted to those TOTH staff and designated agents who have a need to know the specific information in question in order to carry out their responsibilities concerning recruitment or employment law. Your information may also be disclosed to governmental entities in compliance with applicable law, such as to those agencies authorized to review and enforce equal opportunity laws. We do not disclose applicant information to job banks, or to other companies or external parties.

Further, TOTH uses appropriate administrative, technical, personnel, and physical measures to safeguard your personal information against loss, theft, and unauthorized use or modification. In addition, we exercise special precautions in dealing with applicant personal data defined as sensitive by law.

Your Choice

Providing your personal information is voluntary. However, if you choose not to provide all of the data that is requested for your application, our ability to consider you as a candidate may be limited.

How Long Will We Keep Your Job Application Data

TOTH retains your personal information indefinitely but for a period of no less than one (1) year for evaluation of employment, as well as to comply with applicable laws relating to the evaluation of those seeking employment. You may request in the applicant portal to have your account deleted, but the request will be denied if it doesn't meet the required legal retention period. If this occurs, you will be notified of the rejection to delete the account.

Your Rights

Once you have created a job applicant account, you can access your Job Application Data and update it by logging into TOTH's job application portal at https://tothassociates.com/toth-career-portal

Applicants From California

The California Consumer Privacy Act ("CCPA") provides California job applicants with specific privacy rights. Applicants are entitled to receive notice about the categories of personal information TOTH collects about them and how that information is used, as described throughout this policy. Please contact TOTH, via the methods described below, with inquiries, questions, or requests regarding TOTH's processing of your personal information.
